Commerce Department of Sichuan Province

  Functions:

  1) To implement state development strategies, guidelines and policies on domestic and foreign trade, foreign investment and international economic cooperation, and draft relevant policies, local rules and governmental regulations on domestic and foreign trade, foreign investment and international economic cooperation in Sichuan Province; and to draft and enforce development plans and annual plans on commerce in Sichuan Province .

  2) To implement guidelines and policies on national distribution system reform; and to develop urban and rural markets, and promote the restructuring of the distribution sector and the development of such modern distribution methods as chain store operation, modern logistics and electronic commerce.

  3) To implement state policies and measures for regulating market operation and distribution order and breaking market monopoly and regional blockade, and set up and improve an integrated, open, competitive and orderly market system; to monitor and analyze market activities and supply of and demand for commodities; and to exercise control and regulation on key consumer goods market and management over the distribution of major means of production.

  4) To formulate local rules and regulations for commercial distribution and catering service in Sichuan Province; to make studies on important issues of commercial distribution and put forth policy suggestions; to take charge of the supervise and administration on such particular commodities and sectors as cocoon silk, wine, auction and pawnbroking; and to take charge of relevant matters in relation to pig slaughtering.

  5) To implement state measures on the administration of import and export commodities, and comply with the catalogue on import and export commodities and policies on quota bidding of import and export commodities; and to draft, issue to lower authorities and arrange the enforcement of quota planning of import and export commodities.

  6) To implement state policies concerning foreign trade of technology, import and export control, and encouraging the export of technology and complete sets of equipment; to promote the building of standardization system of import and export trade; to supervise technology import, equipment import, state-restricted export of technologies subject to state export restriction and the export and re-export of imported technologies; to take charge of the administration and applications for export licenses concerning nuclear non-proliferation.

  7) To organize and coordinate matters concerning anti-dumping, countervailing, safeguard measures and other matters in relation to fair trade of import and export; to establish an early warning mechanism on fair trade of import and export; to organize industry injury investigations; to provide guidance on and coordinate matters concerning litigations of antidumping, countervailing, and safeguard measures instituted by foreign parties against export commodities of Sichuan Province.

  8) To enforce state policies and reform programs on foreign investment, and provide guidance on matters concerning foreign investment in Sichuan Province; to analyze and make studies into foreign investment in Sichuan Province and submit relevant information and suggestions to Sichuan Provincial Government on a regular basis; to draw up and enforce administrative regulations on foreign investment, participate in the formulation of medium-term and long-term planning and development strategies for foreign investment; to examine and report to higher authorities the establishment and changes of foreign-invested enterprises with foreign investment beyond the state fixed amount, engaging in restricted business, or involving quota and license administration; to verify the contracts and articles of association of foreign-invested projects throughout Sichuan Province in accordance with laws, as well as major subsequent changes particularly prescribed by law; to supervise the enforcement of relevant laws, regulations, rules, contracts and articles of association in foreign-invested enterprises; to provide guidance on and administer province-wide efforts in promoting investment and facilitating investment, and examine and approve foreign-invested enterprises, as well as import and export by such enterprises; to provide guidance on and coordinate relevant matters concerning state-level economic and technological development zones in Sichuan Province and export processing zones; and to take charge of statistics on foreign-invested enterprises and the operation thereof.

  9) To take charge of matters concerning foreign economic cooperation; to formulate and implement policies and regulations on foreign economic cooperation, and provide guidance on and monitor the management of overseas project contracting, labor services cooperation, and designing and consulting businesses; to work out administrative measures and specific policies guiding outbound investment in Sichuan Province; to examine and approve the establishment of overseas enterprises (excluding financial companies) invested by domestic enterprises in Sichuan Province and projects of processing and assembling business with materials in foreign countries and supervise the operation thereof; to keep in contact commercial representative offices delegated by foreign countries, the Hong Kong Special Administrative Region, Macao Special Administrative Region and Taiwan; to carry out the State¨s foreign aid projects; and to manage the grants and donations made by UN, international organizations and foreign governments to Sichuan Province in respect of economic and technological cooperation.

  10) To implement policies, medium-term and long-term programs and administrative rules on foreign trade with Hong Kong, Macao and Taiwan; and to provide guidance to trading institutions in Sichuan Province in establishing trade cooperation with relevant trading institutions in Hong Kong, Macao and Taiwan.

  11) To draw up and enforce administrative measures concerning going abroad and hosting all kinds of trade fairs, exhibitions and sales expositions; and to administer and supervise all kinds of trade fairs, exhibitions and sales expositions held in China in the name of Sichuan Province.

  12) To take charge of press release and publicity in respect of domestic and foreign trade, foreign investment and international economic cooperation and provide relevant information and consultancy service; and to provide guidance on the construction of information network and electronic commerce in the field of commerce in Sichuan Province.

  13) To take charge of the development of commercial organizations overseas delegated by governmental organs and public institutions in Sichuan Province, and select and manage personnel for such organizations; and to provide guidance on the operation of commercial associations and institutes and other social organizations in Sichuan Province.

  14) To undertake other tasks assigned by Sichuan Provincial Government.

  Constitution of the Department

  The Foreign Trade and Economic Cooperation Department of Sichuan Province consists of twelve functional offices and the Department Committee of the CPC.

  1. General Office

  The General Office shall deal with daily administration in the Department and undertake the tasks assigned by the leadership. The Office shall organize important conferences and supervise the implementation of resolutions made in such conferences. The Office shall take charge of secretarial matters, office automation, press release and publicity, the edition and examination of foreign trade and economic briefings, release of government information, confidentiality, file keeping, communications, documents and printing, matters in relation to letters and visits from the public and objective management. The Office shall take charge of reception and coordination of internal affairs. The Office shall provide guidance on work safety in the subordinate units of the Department. The Office shall also coordinate or undertake other tasks assigned by the leadership of the Department.

  2. Office of Personnel Education and Labor

  The Office of Personnel Education and Labor shall take charge of such work in the Department and its subordinate units as the management of public servants, institutional establishment, quality improvement of administrative staff, management of cadres supervised by the Department and political examination of personnel leaving the country. The Office shall provide guidance on matters concerning salary in the foreign trade and economic sector. The Office shall take charge of the selection and management of personnel working in institutions abroad and in Hong Kong and Macao Special Administrative Regions delegated by the Department and its subordinate units. The Office shall take charge of the management of professional and technical titles in the subordinate units of the Department, and the assessment of professional qualification of senior international commercial specialists throughout Sichuan Province. The Office shall take charge of the management of foreign trade schools and educational institutions for national civil servants that are affiliated to the Department. The Office shall formulate and enforce programs and plans in relation to the training of professionals and cadres in the fields of international trade.

  3. Policy and Law Office

  The Policy and Law Office shall conduct research on development trends of domestic and international economy and trade, analyze foreign trade and economic situation in Sichuan Province, and put forth development strategies and major policies of Sichuan Province on international economy and trade. The Office shall make studies into, organize the implementation of and provide guidance on foreign trade system reform and enterprise reform; to conduct research on key issues, difficult issues and issues of general concern affecting foreign trade and economic development throughout Sichuan Province and put forward relevant policy measures and suggestions. The Office shall organize and coordinate the research work. The Office shall draw up important documents of the Department and leadership speech. The Office shall administer affairs in relation to legal regulations in the Department, and organize the drafting of regulations, rules and implementing rules with respect to foreign trade and foreign investments. The Office shall take charge of the matching among regulations and rules on foreign trade and economy. The Office shall take charge of the work in relation to law popularization, law enforcement and legal training in foreign trade and economic authorities. The Office shall participate in research on and coordinate major economic and trade agreements, contracts, articles of association and bills. The Office shall deal with administrative reconsiderations and administrative litigation. The Office shall deal with relevant matters concerning anti-dumping, countervailing and safeguard measures in accordance with laws, and provide guidance on and coordinate the response to anti-dumping suits on export commodities of Sichuan Province. The Office shall also provide guidance on the implementation of international trade and economic treaties and agreements in Sichuan Province.

  4. Office of Planning and Finance

  The Office of Planning and Finance shall draft and prepare annual plans on the total volume of import and export and see to the implementation of such plans. The Office shall implement policies in relation to tariff, foreign exchange, taxation, credit, price and insurance. The Office shall select and submit projects for the Central Foreign Trade Development Fund and the management of various foreign trade and economic funds and foreign trade development funds such as the guarantee funds and the small-and-medium enterprises export promotion funds. The Office shall take charge of the management and distribution of foreign affairs funds and infrastructure investment funds. The Office shall take charge of the supervision of state-owned assets in domestic and overseas units directly affiliated to the Department and the liquidation and verification of properties and capital in such units. The Office shall supervise the examination, adjustment, summarization and submission of overall budget and the submission, approval and enforcement of final accounts of the Department. The Office shall provide guidance on housing system reform in subordinate units of the Department. The Office shall provide guidance on and manage financial and accounting affairs in foreign trade and economy. The Office shall take charge of the statistical work concerning import and export business and sort out and provide various statistical data in foreign trade and economy. The Office shall monitor and analyze the situation of foreign trade and economic cooperation. The Office shall participate in related matters concerning poverty alleviation. The Office shall also take charge of audit supervision on the subordinate units of the Department.

  5. Office of Foreign Trade and Economic Development

  The Office of Foreign Trade and Economic Development shall investigate and conduct research on major issues in import and export trade in Sichuan Province and put forth suggestions on the promotion of foreign trade. The Office shall formulate and implement strategies, policies and measures concerning market diversification. The Office shall monitor and analyze the macro operation of foreign trade in Sichuan Province and promote the development of foreign trade. The Office shall popularize various trade modes. The Office shall enforce the criteria for enterprises eligible for foreign trade business, and undertake statutory examination and determination of such eligibility. The Office shall examine and submit to higher authorities for approval the establishment of trading enterprises (excluding financial enterprises) invested and started by enterprises in Sichuan Province, and draft and see to the implementation of relevant administrative measures and policies. The Office shall provide guidance on and coordinate the construction of export supply bases and organize the enforcement of brand strategy of export commodities. The Office shall take charge of the administration of import and export licenses. The Office shall provide guidance on and supervise various foreign-related trade fairs and exhibitions held in Sichuan Province. The Office shall provide guidance on export advertising and publicity. The Office shall coordinate the implementation of inter-country (inter-region) and multilateral trade policies. The Office shall also take charge of the assessment, submission to higher authorities for approval and administration of the eligibility of running an international freight forwarding agency, and provide guidance on and coordinate foreign trade shipping and warehousing business.

  6. Office of Foreign Trade Administration

  The Office of Foreign Trade Administration shall implement policies on quota bidding and processing trade of import and export commodities, and provide guidance on and coordinate relevant affairs in relation to export processing zones and bonded areas (plants or warehouses). The Office shall determine and enforce plans on import and export commodity quotas (including various trade modes) of Sichuan Province. The Office shall coordinate and regulate the business on import and export. The Office shall take charge of relevant matters subsequent to the registration of export commodities trademarks. The Office shall take charge of import and export control on precursor chemicals. The Office shall take charge of the examination, submission to higher authorities for approval and administration of resident representative offices in Sichuan Province delegated by foreign countries and the Hong Kong and Macao Special Administrative Regions. The Office shall implement policies, planning and administrative rules in relation to trade with Hong Kong, Macao and Taiwan. The Office shall also provide guidance on trade negotiations between foreign trade institutions in Sichuan Province and trade organizations of Hong Kong, Macao and Taiwan.

  7. Office for Import and Export of Machinery and Electrical Products

  The Office for Import and Export of Machinery and Electrical Products shall conduct research on and implement the policies and regulations promoting import and export of machinery and electrical products. The Office shall draft and implement medium-term and long-term schemes and annual plans in relation to the import and export of machinery and electrical products. The Office shall monitor the import and export of machinery and electrical products in Sichuan Province, and sum up, analyze, and distribute relevant data. The Office shall adjust the export commodity structure of machinery and electrical products, and promote the construction of export production system of machinery and electrical products and the technological upgrading of export manufacturing enterprises. The Office shall provide guidance on, coordinate and administer export projects of complete sets of large machinery and electrical equipment, organize the expansion of international markets of machinery and electrical products, and implement the annual schemes concerning export quotas of machinery and electrical products. The Office shall take charge of the supervision and law enforcement of tender invitation and bidding activities in relation to import procurement projects of machinery and electrical equipment throughout Sichuan Province. The Office shall also oversee the implementation of relevant tariff regulations, tariff items and tariff rates and participate in relevant negotiations.

  8. Office of Foreign Economic Cooperation

  The Office of Foreign Economic Cooperation shall implement policies and regulations with respect to foreign economic cooperation. The Office shall provide guidance on the expansion of overseas markets and regulate the market order. The Office shall deal with major affairs in foreign economic activities. The Office shall administer and coordinate relevant matters concerning international project contracting, labor services cooperation, designing and consulting business and projects of processing and assembling business with materials in foreign countries. The Office shall take charge of statutory examination and approval of foreign trade enterprises¨ eligibility. The Office shall provide guidance on, supervise and administer multilateral and bilateral non-reimbursable aids and donations. The Office shall take charge of relevant professional training. The Office shall examine and submit to higher authorities for approval the establishment of overseas non-trade enterprises invested and started by domestic enterprises and see to the supervision of such enterprises. The Office shall take charge of the export administration on complete sets of equipment in international project contracting. The Office shall also take charge of related matters concerning foreign aids.

  9. Office of Foreign Investment Administration

  The Office of Foreign Investment Administration shall formulate and implement the policies and administrative rules concerning attracting foreign investment in Sichuan Province and participate in the formulation of development strategies and medium-term and long-term planning in relation to foreign investment. The Office shall provide guidance on and administer affairs with respect to attracting foreign investment and investment promotion, and organize and coordinate relevant activities related to attracting foreign investments. The Office shall assist the Ministry of Foreign Trade and Economic Cooperation with administration and coordination of the operation of nation-level economic and technological development zones in Sichuan Province. The Office shall summarize and release the Catalogue for the Guidance of Foreign Investment Industries. The Office shall approve the establishment of foreign-funded enterprises within the prescribed limits by the State. The Office shall also approve contracts and articles of association in relation to foreign investment projects and issue the approval certificates.

  10. Office of Foreign-funded Enterprises

  The Office of Foreign-funded Enterprises shall take charge of the administration and coordination concerning foreign-funded enterprises. The Office shall supervise and inspect the implementation of relevant laws and regulations, contracts and articles of association by foreign-funded enterprises, and coordinate and find solution to relevant problems. The Office shall provide guidance to all localities and departments in strictly implementing foreign investment policies formulated by the State and Sichuan Province. The Office shall approve, issue and see to the enforcement of the Understanding Card of Sichuan Province concerning Charge Items related to Foreign-funded Enterprise. The Office shall examine the alteration of contracts and articles of association and the termination and liquidation of foreign-funded enterprises. The Office shall provide guidance on and administer the import and export business of foreign-funded enterprises. The Office shall prepare and oversee the implementation of annual plans concerning the foreign-funded enterprises¨ import and export commodities subject to the State quota license administration and coordinate the issues rising during the implementation of such plans. The Office shall identify and assess of foreign-funded export-oriented enterprises and advanced technologies. The Office shall take charge of the statistical work in relation to foreign investments, undertake comprehensive analyses and report to Sichuan Provincial Government on relevant development trends. The Office shall also carry out joint annual inspections on foreign-funded enterprises in accordance with the law.

  11. Office for Technological Development and Import and Export of Technology

  The Office for Technological Development and Import and Export of Technology shall draft and implement policies and administrative rules in relation to foreign technology trade and policies encouraging technology export. The Office shall implement the strategy of revitalizing trade through science and technology, regulate and promote the export of high-tech products, provide guidance on the introduction of high and innovative technologies and promote the structural adjustment on export products in Sichuan Province. The Office shall implement the State relevant policies in relation to technology export control and relevant planning, guidelines and policies in relation to technology trade. The Office shall provide guidance on the export of high-tech products of high-tech-oriented enterprises, bases and industrial parks and promote the combination of science and trade, technology and trade as well as industry and trade. The Office shall take charge of the expansion and coordinated management of technologies and import and export markets of high and innovative technologies. The Office shall also take charge of matters in relation to technological development and progress, informatization and standardization of foreign trade and economy.

  12. Office of International Liaison

  The Office of International Liaison shall formulate rules and regulations in relation to the foreign affairs of the Department. The Office shall provide guidance on foreign affairs and guest reception in foreign trade and economic authorities. The Office shall take charge of the foreign affairs, guest reception and major foreign activities of the Department. The Office shall arrange foreign affairs and overseas visits for relevant leaders, and invitation and reception of foreign trade and economic delegations and other delegations. The Office shall take charge of the external publicity on foreign trade and economy in Sichuan Province. The Office shall also coordinate with relevant departments in Sichuan Province on foreign trade with Taiwan.

  13. The Department Committee of the CPC

  The Department Committee of the CPC shall take charge of Party-and-mass relation in the Department and subordinate units. The establishment of executive offices of the Department Committee shall be determined by the Party Group of the Department in accordance with relevant provisions of Sichuan Provincial Committee of the CPC.
