Major duties:
1.The department carries out the principles, policy, laws and regulations of the national land and mineral resource, is responsible for formulating management laws and regulation of natural resource including land and mineral resource in the province, and administrative reconsideration in accordance with law, researching and drawing up the policy of land and mineral resource planning, management, protection and reasonable utilization, organizing to implement technical standard, regulations, rules and measures of land and mineral resource, management.
2.The department organizes to draft and implement national land program, overall plan of land utilization, specific land usage program and annual plan of land utilization, takes part in examination and verification of overall urban plan submitted to provincial government and state council for approval, undertakes preliminary examinations of the program of land used in construction project, gives guidelines and exams and verifies overall plan of local land utilizations, organizing an investigation and evaluation of mineral resource, formulates protective and reasonably used plan for mineral resource, geological prospecting plan and the plan for geological disaster prevention and geological vestiges protection.
3.The department exams and supervises administrative law enforcement of competent departments of land resource at all level in the province and implementation of mineral resource plan, protects the legal rights and interests of owners and users of land and mineral resource, is responsible for investigation and mediating the disputes on the proprietary of land and mineral resource, deal with the transgression of land and mineral resource law.
4.The department draws up and carries out the policies of cultivated land which should be specially protected, encouraging exploited and well arranged, practises the management control for usage of land, undertakes protection work for basic farmland, takes charge of the management and supervision for the exploitation of unutilised land, arrangement of land, re-ploughing of land, exploitation of cultivated land and land reserves, insures the balance between diverting and compensation of cultivated land and keep the reasonable proportion of cultivated land in the province.
5.The department formulates and carries out the measures for the management of land registration, organizes the investigation and evaluation of land resource, investigation of land registration, statistics and dynamic supervision of land; takes charge of land confirmation, land registration both in urban and rural areas, land classification, enrolment and issuing certifications in accordance with laws.
6.The department drafts and, according to the regulations, organizes to implement the management measures in sale, leasehold, evaluating, transfer, trade and governmental purchase of land use-right; draws up, examines and authorizes the schemes of diverting farmland, land requisition, compensating cultivated land and land providing, directs the management of land use-right in township and village and the circulation management of rural collective un-farmland use-right.
7.The department directs the evaluation of the benchmark and demarcating the price of land; examines and approves the qualification of evaluation organizations engaged in land evaluation; confirms the price of land use-right; undertakes the examining and submitting work of the land in different use, approved by the provincial people’s government and State Council; takes charge of the management and requisition of the expense of land compensation, settlement compensation, land for cultivation, land usage with payment, land leaving unused and so on, implement the relevant budget.
8.The department administrates the examination, enrolment, issuing certifications and transfer of prospecting right and mining right in mineral resource in accordance with laws; examines and organizes to implement the cooperation with foreign countries; undertakes the management of mineral resource reserves and compiling of mineral materials (stuffs); management of the geological prospecting industry, qualification of the geological prospecting units, and management of the geological prospecting results, management of levying and use of compensation fee for mineral resources in accordance with laws; approves qualification of the evaluating organizations engaged in evaluation of prospecting and mining right; and confirms the evaluating results of prospecting and mining right.
9.The department is responsible for observation, prevention of the geological calamity and protection of the geological remains; undertakes management of the prospecting and evaluation of the hydrogeology, engineering geology, environmental geology; observation and supervision of the over-exploitation and pollution of ground water, auditing the evaluation report on the influence of geologic environment and protection of the geologic environment; organizing experts to check, confirm and submit to the above department the paper materials of protection area of geological remains with valuable fossils of ancient extinct life, standard geologic section, and approving the development of geologic nature preservation zone according to the regulations; organizing the identification and annual examination of terrestrial heat and mineral water.
10.The department arranges and supervises the spending of related outlay appropriated by the Ministry of National Finance and provincial finance department.
11.The department is responsible for foreign cooperation and exchanges in the field of land and mineral resource.
12.The department undertakes the other proceedings assigned by the provincial government.
According to the classification by the provincial government, the Provincial Bureau of Prospecting and Exploitation in Geology and Mine is under the leadership of the department, the Migration Leading Group Office of Giant Hydro-power Project Migration is merged into this Department of National Land and Resource, and the office title is still kept for use.
